Open Burning

Call 503-769-3400 to see if it is a burn day, before you burn.  The burn number is updated daily after 8am.  If it is a burn day the system will tell you what time you can start burning and what time fires have to be out.  Outdoor burning is not allowed outside of the open burning seasons.

Safety Concerns

  • Must be attended until the fire is completely burned out or extinguished
  • Keep the area around the burn area clear (down to mineral soils is best)
  • Do not locate fire under overhead lines and overhanging trees or near fences and structures
  • Always have a shovel and water hose nearby to extinguish the fire

What is open burning?

"OPEN BURNING" includes any burning outdoors, including burning in a burn barrel, outdoor fireplace or backyard incinerator.   The Department of Environmental Quality (DEQ) regulates open burning.  DEQ has the authority under state law to prohibit open burning anywhere in the state on a day-to-day basis. 

 What materials are prohibited?

Rubber products, tires, plastic, wet garbage, petroleum and petroleum-treated materials, asphalt or industrial waste, or any material that creates dense smoke or noxious odors.

Agricultural Burning

Agricultural burning permits are required from June 16 to September 30th.  To obtain a permit call the District Office at 503-769-2601 during regular working hours or if you live in the forest protection areas of the District, you must call the Oregon Department of Forestry at 503-859-2151.  Agricultural permits are not required during open burning seasons but you must call, if you plan to burn stumps or a very large pile.

What areas are in the forest protection area?

East of Stayton and North of the Santiam River, including Old Mehama Road, Fern Ridge Road, Hwy 22 (from Stayton East), Mehama, North Fork Road, Gates, Mill City, and Lyons.  This is for agricultural permits during fire season from June 16 to September 30th.

Do I qualify for Agricultural Burning?

Agricultural burning is limited to bona fide agricultural waste.  Agricultural waste is material generated by an agricultural operation that uses, or intends to use, land primarily for the purpose of obtaining a profit in money by raising, harvesting and selling crops or raising and selling animals (including poultry), or the products of animal husbandry.  Prohibited materials can't be burned, even in an agricultural setting

Agricultural burning must be an integral and necessary part of the agricultural activity.  The agricultural activity might include clearing of land, but does not include construction and use of dwellings.

Note - Burning associated with a dwelling (even if it is on a farm) is considered to be domestic burning, backyard burning or burning of yard debris, and is not part of the farming operation.  The burning must be an integral and necessary part of the agricultural activity to qualify as agricultural burning.

Field Burning
